Ask Officer Michelle – Question #309

Posted by skollman

I have read all the laws in California pertaining to motorized bicycles (as defined in Vehicle Code Section 406), but none of the laws talk about which rules of the road these motorized bicycles have to obey. There is an entire section on which rules bicycles have to obey, as well as for motorized scooters. Can you please clarify: if you are riding a motorized bicycle, which rules of the road are you subject to? Thank you very much.

Dear skollman,

The motorized bicycle ( 2 or 3 wheels with operative petals for propulsion by human power) has virtually the same laws as that of a person riding a bike including riding in the bike lane. Motorized bicycles must comply with the same standards as motorcycles for headlight, taillights, and brake lights. Last but not least, according to 24016b of the California Vehicle Code, a bicycle helmet is required. Be safe!

Officer Michelle
