Ask Officer Michelle – Question #458
Posted by tbishop
What can you do if a house guest has overstayed their welcome and when asked to find other accomodations will not leave?
Dear tbishop,
This depends on how long your guest has been staying. If they are considered "guests" and you ask them to leave and they refuse, then they are trespassing. You can call the police for trespassing. We will respond and assess the situation. If, however, they have established a residency at your home, ie. receive mail, and have been living with you for awhile, you may have to go through the eviction process. The police don’t get involved in this situation. You can read more about this at http://www.hrfh.org/forms/2010_Fair_Housing_Handbook.pdf
If your guest becomes hostile toward you after your request, you may want to call us for that as well. We don’t do civil stand-by’s (when an officer stays on scene while another party retrieves items). We do come out if it is some type of domestic situation where there is a likelihood that there may be a problem. I hope you will be able to regain your living space soon. Thank you for your post.
Officer Michelle
