If both parents are using drug, how can the Grandmother receive Child Custody over the toddler?

Dear liz,

First off, I want to say that I’m so sorry that you and that child have to deal with these issues, and thank God that child has you to assume the responsibility as the guardian and to give them what they need to thrive.

I want you to contact the Sacramento County Protective Services (CPS). You can email them by going to the website at: http://www.dhhs.saccounty.net/CPS/Pages/CPS-Home.aspx, or you can call them at 875-KIDS. Speak to a case worker about what is going on. They will send someone out to investigate. If the child is in immediate danger and if they are being abused, you can call the police. If you live in the city, call the Sacramento Police Department at 264-5471. If you live in Sacramento County, call 874-5115. If you suspect that the child is being abused, (they appear malnourished, they have visible bruising, burns, scars, they verbalize that they are being hurt or placed in a dangerous situation), call the police.

You would have to go through family court to be awarded custody of the child, but you first have to have some reason for it and some substantiated documentation. For the sake of the child, I hope this turns out. Thank you.
