Ask Officer Michelle – Question #556
Posted by originalgabriel
One of my housemates has a large amount of pot cookies and does not have a medicinal license. I’ve asked them several times to get rid of them (mainly because of the space they are taking up in the freezer) but they have all but refused (usually asking me to help them sell them, which I refuse).
I’m hesitant to throw them out myself, as I fear them throwing out (legal) belongings of mine. Is it possible to have the police come by to remove these items themselves.
Dear originalgabriel,
The marijuana laws have changed significantly over the past 5 years. According to federal law, marijuana possession is still illegal. Some states allow marijuana for medicinal purposes as you know. In Sacramento County, it is an infraction to possess under 28.5 grams of marijuana; which is an equivalent to a traffic ticket. I can’t tell you how much marijuana is baked into those brownies. I can tell you that the police won’t respond out to your residence to throw out some baked goods containing marijuana.
If the brownies belong to juveniles, or if there are juveniles present who may confuse the brownies for legitimate treats, you could call us for a child endangerment issues. You may want to mention this to your roommates if this is the case. If your roommate is selling these brownies, this could also make a difference. Possession and sales are two separate issues that make a big difference.
Lastly, you may want to speak with your landlord about this topic. An eviction notice may be what is warranted and will be a more permanent solution. Thank you for posting.
